By signing this Agreement, I acknowledge and agree to the following terms and conditions regarding my use of the facilities, services, programs, equipment, and premises of Tennis and Pickleball Club of Newport Beach, including its affiliated entities, owners, operators, employees, contractors, instructors, agents, sponsors, vendors, and related parties (collectively referred to herein as the "Club").
1. Assumption of Risk
I understand and acknowledge that participation in tennis, pickleball, fitness activities, recreational sports, lessons, clinics, tournaments, events, and use of the Club's facilities and equipment involve inherent risks of injury, illness, property damage, and death.
These risks may include, but are not limited to:
- Slips, trips, and falls
- Collisions with other participants
- Injuries caused by racquets, balls, nets, or equipment
- Muscle strains, sprains, fractures, or torn ligaments
- Heat exhaustion, dehydration, or other medical conditions
- Equipment malfunction or failure
- Negligence of other participants or third parties
- Injuries occurring in courts, locker rooms, walkways, parking areas, dining areas, pro shops, or anywhere on Club premises
I voluntarily accept and assume all risks, known and unknown, associated with participation in activities at the Club.
2. Release and Waiver of Liability
To the fullest extent permitted under California law, I hereby release, waive, discharge, and covenant not to sue the Club from any and all claims, demands, liabilities, damages, costs, expenses, actions, or causes of action arising out of or related to any loss, injury, illness, death, or property damage that may occur while I am participating in activities at the Club or using the Club's facilities, equipment, or services, whether caused by the ordinary negligence of the Club or otherwise.
This release applies to all claims, including claims for personal injury, wrongful death, property damage, loss of consortium, emotional distress, or economic loss.
I understand that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of California.
3. Medical Acknowledgment
I represent that I am physically capable of participating in Club activities and that I do not have any medical condition that would create an unreasonable risk to myself or others.
I understand that it is my responsibility to consult with a physician before participating in physical activity if I have any health concerns.
I authorize the Club to obtain emergency medical treatment for me if necessary. I understand that I am solely responsible for any medical expenses incurred.
4. Indemnification
I agree to indemnify, defend, and hold harmless the Club from and against any and all claims, liabilities, damages, costs, or expenses, including attorneys' fees, arising from my actions, conduct, participation, or presence on Club premises.
5. Rules and Conduct
I agree to comply with all Club rules, policies, instructions, and safety guidelines. I understand that failure to comply may result in removal from the premises or suspension of privileges without refund.
6. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
7. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California.
8. Acknowledgment and Understanding
I acknowledge that I have carefully read this Agreement, fully understand its contents, and understand that I am giving up substantial legal rights by signing it. I sign this Agreement freely and voluntarily without inducement.
