Every guest signs this once. By signing, you're acknowledging the rules of play and releasing the Club from liability for the inherent risks of pickleball and tennis.
Release of Liability, Assumption of Risk, and Indemnity Agreement
By signing this Agreement, I acknowledge and agree to the following terms regarding my use of the facilities, services, programs, equipment, and premises of TTC Newport Beach LLC, TTC Newporter LLC, TTC Palms LLC, TTC Coto LLC, World Team Pickleball LLC, and Champion Management Group Inc., together with each of their affiliated entities, owners, officers, directors, employees, contractors, instructors, coaches, agents, and related parties (collectively the "Club" or "Released Parties").
1. Assumption of Risk. Participation in tennis, pickleball, fitness activities, lessons, events, and use of the Club's facilities and equipment involves inherent risks of injury, illness, property damage, and death. These risks include slips, trips, falls, collisions with other participants, injuries from racquets / balls / nets / equipment, muscle strains and fractures, heat exhaustion, equipment failure, negligence of other participants, and injuries occurring anywhere on Club premises. I voluntarily accept and assume all such risks, known and unknown.
2. Release and Waiver. To the fullest extent permitted under California law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, liabilities, damages, costs, or causes of action arising out of any loss, injury, illness, death, or property damage that may occur while I am at or using the Club's facilities, equipment, or services, whether caused by the ordinary negligence of the Released Parties or otherwise.
3. Medical. I confirm I am physically fit to participate in the activities I'm taking part in. I assume responsibility for any medical condition that may affect my participation.
4. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or attorneys' fees arising from my actions, conduct, participation, or presence on Club premises.
5. Club Guidelines & Guest Policy. I agree to comply with all Club rules and safety guidelines. As a guest, I understand: my first six visits are subject to a $35 guest fee each, and visits after that are $50 each, payable by any method; at Friday Night Socials a member may bring two guests at no charge with no food and beverage minimum, and additional guests enter free with a $20 food and beverage minimum taken at check-in and applied to purchases that evening; non-members may join group ladders only when space allows and by approval, for a $30 fee, with members always given first priority. A credit card is captured on file at the door for every guest, including complimentary entries. Guests cannot participate in ladders, leagues, or ranked events. The Club reserves the right to remove anyone from the premises for failure to comply.
6. Severability & Governing Law. If any provision of this Agreement is found unenforceable, the rest remains in effect. This Agreement is governed by California law.
7. Electronic Signature. I understand that checking the agreement box below, providing my name and contact information above, uploading my government-issued identification, and submitting this form constitutes a legal electronic signature under the federal ESIGN Act (15 U.S.C. ch. 96) and California Uniform Electronic Transactions Act (Civ. Code §§ 1633.1-1633.17), with the same legal effect as a handwritten signature.
8. Acknowledgment. I have read, understood, and voluntarily agreed to all eight sections of this Agreement.
